These Terms and Conditions govern your use of the website www.schillair.com.au and the air conditioning services provided by Schillair (ABN 53 611 453 171, Licence No. L296530C), operating across Sydney, NSW, Australia.

By using our website or engaging our services, you agree to these terms. If you do not agree, please do not use our website or services.

1. Services

Schillair provides air conditioning supply, installation, repair, and maintenance services for residential and commercial properties in Sydney. All services are provided by licensed and qualified technicians in accordance with applicable Australian standards and regulations.

2. Quotes and Pricing

  • Quotes provided through our website or in person are estimates only and may be subject to change following on-site inspection.
  • All prices are quoted in Australian Dollars (AUD) and are inclusive of GST unless otherwise stated.
  • Product prices displayed on our website are indicative and subject to availability and supplier pricing at the time of order confirmation.
  • A formal written quote will be provided before any work commences. Work will not proceed without your written or verbal acceptance of the quote.

3. Payment Terms

  • A deposit may be required before commencement of work, as specified in your quote.
  • Final payment is due upon completion of the work unless alternative payment terms have been agreed in writing.
  • We accept payment by credit card, debit card, bank transfer, and other methods as specified at the time of booking.
  • Late payments may incur interest at the rate permitted under applicable legislation.

4. Australian Consumer Guarantees

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms limits, excludes, or modifies your rights under the Australian Consumer Law.

5. Warranties

  • Manufacturer Warranty: All air conditioning products supplied by us carry the manufacturer’s warranty as specified by the relevant brand. Warranty terms vary by manufacturer and product.
  • Workmanship Warranty: Our installation and repair work is covered by a workmanship warranty as specified in your individual quote or service agreement.
  • Warranty claims should be directed to us in the first instance. We will liaise with the manufacturer on your behalf where applicable.

All work is carried out in compliance with the relevant Australian Standards, the NSW Home Building Act 1989, and applicable work health and safety legislation.

7. Cancellations and Rescheduling

  • Cancellations or rescheduling requests must be made at least 24 hours prior to the scheduled appointment.
  • Late cancellations or missed appointments may incur a call-out fee as specified at the time of booking.
  • We reserve the right to reschedule appointments due to weather, supply issues, or unforeseen circumstances. We will notify you as soon as practicable in such cases.

8. Access and Site Requirements

You are responsible for providing safe and reasonable access to the installation or service site. This includes:

  • Clearing the work area of personal belongings and obstructions
  • Ensuring electrical supply is available where required
  • Providing access to roof spaces, sub-floors, or other areas as needed
  • Advising us of any known hazards such as asbestos prior to commencement of work

9. Website Use

  • All content on our website including text, images, logos, and product information is the property of Schillair or its licensors and is protected by Australian intellectual property laws.
  • Product specifications and images are sourced from manufacturers and are provided for reference only. We do not guarantee accuracy of manufacturer-supplied specifications.
  • Our website may contain links to third-party websites. We are not responsible for the content or privacy practices of those sites.

10. Limitation of Liability

To the maximum extent permitted by law and subject to the Australian Consumer Guarantees in section 4, our liability for any claim arising from the use of our website or services is limited to the amount paid by you for the relevant service.

We are not liable for indirect, consequential, or incidental losses including loss of profits, data, or business opportunity, except where such exclusion is prohibited by law.

11. Dispute Resolution

If a dispute arises, we encourage you to contact us directly to resolve the matter. If we cannot reach a resolution, either party may refer the dispute to NSW Fair Trading or another appropriate dispute resolution body before commencing legal proceedings.

12. Governing Law

These terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.

We may update these Terms and Conditions from time to time. Changes will be posted on this page with an updated revision date. Continued use of our website or services constitutes acceptance of the updated terms.
